Process & Timescales

Step 1

Design interview

To start our design project, we need to get to the bottom of who you are, what you stand for, and who you stand beside.

Only then we can begin to portray the value you offer in a way that resonates with the people who matter: the clients you want to do business with

Step 2

Design presentation

Three new design concepts will be made. Naturally, there will be a common theme but we will try to think outside of the box and come up with a few different solutions. The brainstorming and comparison part is often where the best ideas come from.

We will go through these options and decide which direction to take and which adjustments to make.

Step 3

Website content

Now that we have your design decided on, we can begin to construct the website. Our copywriter will be in touch with you to help put your ideas down through the "voice" of your new brand.

Any photos attempted to use on the website will have to be gathered at this stage.

Step 4

Website build

Using everything we have gathered, we will start building your website. Once it is done, we will present it to you and go through the details and finishing touches following the objectives we have originally set.

Any amends are made at this stage.

Step 5

Launch

The launch process has to be carefully considered. We need to ensure email addresses will not go down, the site doesn't have any downtime, any old links are re-directed to the new pages, as well as several other things.

The following process has been done by our company many times before, and we have developed a detailed checklist we are working with, that has not failed us once.

We make sure to launch the website late on Friday's, as that gives us a chance to iron out any possible issues. You can sleep well knowing we will be on-call over your launch weekend to ensure everything goes according to plan.

Goals

ABC Legal Company contacted us when they needed to re-brand and build a new website. They have been around for over 20 years and operated with the same marketing material they started with. There is the amount of money that is directly deposited from one company to another, and then there is, what we call, "The Real Cost".

This is the cost of our service, factored into the cost of you doing business, then working out what's left.
During our initial conversation, we asked you what the average transaction value was and the rough amount of profit in each job.

Using that as a starting point,
here is the real cost:

You are currently getting five leads each month from the website and based on that, traffic is about a 0.5% conversion rate. You are also converting one in five leads into clients.

Our guarantee states that we will get it to 2% which will be twenty leads each month.

Your average deal is worth £6,000 p/a, which with your new monthly lead count and assuming your conversion rate stays the same, is four new clients each month at £18,000 p/a increase.

With this laid out, it's clear that by the second month, your investment will be paid back by annual recurring revenue.

Terms & Conditions

Article 1 – SCOPE

This agreement sets forth the terms and conditions whereby Christopher Gunn Creative agrees to shoot and edit certain videos, design and build a website, do branding work, and other items as described and checked off below, for the Client. Neither party is, by virtue of this Agreement, authorized as an agent, employee, or legal representative of the other. Except as specifically set forth herein, neither party shall have the power to control the activities and operations of the other and its status at all times will continue to be that of an independent contractor relationship.

Article 2 – DESCRIPTION OF SERVICES

Christopher Gunn Creative agrees to use reasonable care to ensure that all statements contained within the Videos are true and do not infringe upon the copyright, right of privacy, right of publicity, or any other proprietary right of any third party. Client acknowledges and agrees, however, that full and final verification for accuracy is Client’s responsibility.

Article 3 – EDITS AND APPROVALS

The deadline for video content is subject to the agreed upon video calendar, which will be based upon the results of the Creative Meeting should such a meeting be deemed necessary by both parties. It is understood between the Parties that the Campaigns can evolve and change over time and provisions can be made for these evolutions upon the agreement of both parties. This may incur additional charges or credits subject to the discretion of Christopher Gunn Creative. Due to the volume of videos desired, a maximum of one edit per video in a timely manner is acceptable. Additional edits can be requested for a fee discussed and agreed upon at the time of request. This fee structure is also valid for other services to be rendered unless explcitly discussed between parties or the nature of the content is not reliant upon a video calendar or marketing calendar. If Christopher Gunn Creative does not hear from Client within 2 days of submitting video(s) for approval, it shall be considered approved with no changes necessary.

Article 4 – TAXES

Christopher Gunn Creative herein acknowledges that they will receive an IRS Form 1099-MISC from Client. Client shall not withdraw any applicable tax funds from any fees paid to Christopher Gunn Creative. Christopher Gunn Creative and Client shall each be solely responsible for all of the federal, state, and local taxes applicable to them. SCOPE OF WORK

Article 5 – NONEXCLUSIVITY

Christopher Gunn Creative and Client hereby acknowledge and agree that nothing contained herein is to establish an exclusive relationship between the Parties. Christopher Gunn Creative shall be free to continue working for and taking new clients, without regard to Client. Christopher Gunn Creative does not need Client approval for any such work. Client is also free to hire additional marketers for any of Client’s work and does not need Christopher Gunn Creative’s approval to do so.

Article 6 – CLIENT LEGAL REQUIREMENTS

It is the Client’s sole and exclusive responsibility to ensure that all legal requirements for Client’s business are met. Such legal requirements include, but are not limited to, ensuring claims on advertising and graphics are true, accurate, and may be legally stated, as well as ensuring all products and product sales are lawful. Christopher Gunn Creative shall not be responsible for any legal, technical, or regulatory specifications.

Article 7 – TERMINATION

The Parties may terminate this agreement prior to the specified end date by giving notice in writing. Notice shall be given at least 30 days before termination. This Agreement may be immediately terminated in the event that there is a breach of terms by either Party. If Client finds Christopher Gunn Creative’s work unsatisfactory, Christopher Gunn Creative shall be given the following amount of time for one revision to cure: 7 days. After this cure period, if Client still finds the work unsatisfactory, Christopher Gunn Creative shall not be under any additional obligations. Client shall still be responsible to pay Christopher Gunn Creative all due fees and the Parties may then terminate this Agreement. The Agreement will also immediately terminate upon the death of Christopher Gunn or the Client, the inability of Christopher Gunn to perform the services because of a sudden and medically documented physical or mental disability, the liquidation, dissolution or discontinuance of the business of the Client or Christopher Gunn Creative in any manner, or the filing of any petition by or against the Client or Christopher Gunn Creative under federal or state bankruptcy or insolvency laws. Upon termination for any reason, all fees and reimbursements shall be paid and provided to Christopher Gunn Creative as they have accrued up to the date of termination.

Article 8 – CONFIDENTIAL OR PROPRIETARY INFORMATION

Christopher Gunn Creative hereby acknowledges and agrees that Christopher Gunn Creative may receive confidential and/or proprietary information relating to Client’s business. Such information may include, but not be limited to, client lists, client notes, specifications, project information, plans, and/or technological resources. Christopher Gunn Creative understands and agrees that any unintended disclosure of any of the confidential and/or proprietary information would be significantly detrimental to Client. As such, Christopher Gunn Creative agrees that they shall: • Not disclose the confidential and/or proprietary information by any means not authorized by the Client to any third parties. • Not use the confidential and/or proprietary information for any purpose except those expressly authorized by Client. • Inform Client immediately if Christopher Gunn Creative becomes aware of any unauthorized use or disclosure of the confidential and/or proprietary information.

Article 9 – PORTFOLIO USE

Notwithstanding the specific rights of intellectual property, Christopher Gunn Creative shall be permitted to use all work in Christopher Gunn Creative’s professional portfolio after such work has been made public by the Client. Nothing contained herein shall limit Christopher Gunn Creative’s such right.

Article 10 – INDEMNIFICATION

Christopher Gunn Creative and Client shall each defend, indemnify, and hold the other harmless (including all affiliates, officers, directors, employees, agents, successors, and assigns) from and against all losses, damages, liabilities, deficiencies, actions, judgements, interest, awards, penalties, fines, costs, or expenses of whatever kind (including reasonable attorneys’ fees) arising out of or resulting from bodily injury, death of any person, damage, real or intangible, to personal property resulting from the other’s acts or omissions or the breach of any representation, warranty, or obligation under this Agreement.

Article 11 – FORCE MAJEURE

Christopher Gunn Creative is not liable for any failure to perform due to causes beyond reasonable control including, but not limited to, acts of God, acts of civil authorities, acts of military authorities, riots, embargoes, acts of nature and natural disasters, and other acts which may be due to unforseen circumstances.
